Terms and Conditions

By reading the Terms and Conditions, you acknowledge, understand and agree to accept them.

Liability

Adventurous activities and kayaking on the sea is inherently risky and potentially dangerous. It is the individual’s own responsibility to fully accept all risks, damages, injury or death which may result from such activities. As with many outdoor activities that take place in remote and potentially hostile environments, technical ability, experience and good planning are essential. The sea is one of the most committing and unforgiving environments; it should be treated with the constant respect that it deserves.

Booking Section

Book via the website, or contact via enquiries for booking reservations. Should you need to make any changes to your booking please do so at your earliest convenience.

Cancellation

Our tours and trips require a minimum of 4 participants to go ahead. Summit to Sea Adventures reserves the right to cancel if the tour is under subscribed. This will be decided 14 days before the tour date. In the event that Summit to Sea Adventures needs to cancel the tour or trip you will be refunded in full. For kayaking and walking trips, in the event of adverse weather conditions, safety is our top priority. We reserve the right to cancel any trips if we believe conditions are unsuitable or unsafe. In such cases we will provide as much notice as possible, but cancellations may occur on the day of the trip. Clients will be offered a full refund or the opportunity to reschedule.

If you need to cancel your booking, Summit to Sea Adventures requires notification in writing (confirmed email is also acceptable). The effective date of cancellation will be the date which we receive your notification. We can give you the option to move your tour to another date (subject to availability).

Cancellation fees apply if a booking is cancelled. The cancellation fee percentages based on the notification period are as follows:
- Cancellation 31 days or more prior to the scheduled date: 25% of the total price.
- Cancellation within 1-31 days prior to the scheduled date: 100% of the total price.

Cancellation Terms

In the case of adverse weather affecting tours/ferry sailings, when in Orkney an alternative tour will be offered, or a full refund will be payable. If adverse weather affects your journey to Orkney and therefore you cannot make your tour, then you will need to speak to your Travel Insurance provider.

Prices

Prices quoted include all admissions where stated. Please bring water and snacks for your consumption. All tour prices will be shown on full tour itinerary. Please note that these are present costs and due to rising fuel costs and changes in admission prices may be subject to change. If there may be a change Summit to Sea Adventures will inform you in advance.

Currencies

If you are buying from outside the United Kingdom, when you make your payment using your debit or credit card, you will be debited for the sterling amount and your bank will convert the transaction into your currency.

Vehicle Occupancy and tour base rate

Summit to Sea Adventures vehicle occupancy minimum is four persons per tour. One to three (1-3) persons becomes a Bespoke Private Tour and prices will differ and be available on request. Tours are subject to availability. Please note also that in fairness to all passengers luggage is restricted to one small bag or rucksack for driver guide and walking tours.

Tour Payment

For tours booked within 1 month of your arrival we would require full payment at the time of booking. For tours booked in advance of 1 month of arrival we would require a 25% non refundable deposit with the balance payable 1 month before your tour date.

Payment can be made via the website, BACs transfer or Cash. Any bank charges levied by either the sending or receiving bank when accepting payment by BACs shall be paid by you.

We accept all major Debit and Credit Cards.

Please note that Payment methods may be subject to change.

If full payment is not received within fourteen (14) days of your booking, Summit to Sea Adventures reserves the right to cancel your booking.

Insurance/Adverse Weather

Summit to Sea Adventures strongly recommends that you purchase comprehensive individual/family Travel Insurance. Summit to Sea Adventures will not be responsible for any losses, injuries or damages.

Cruise Ships

We recommend that customers purchase comprehensive individual/family Travel Insurance as should their cruise ship not dock due to adverse weather/sea conditions, or any unforeseen circumstances which may lead to cancellation of the cruise ship arriving in port, then Summit to Sea Adventures will not be held liable. This includes the cruise ship having booked to arrive then cancelling.

Liability

Many of the structures we visit are very old and are not maintained. Entering sites and structures is at your own risk. Summit to Sea Adventures will not cover any liability arising from persons entering such sites and structures.

Right to Refuse Service

Summit to Sea Adventures reserves the right to refuse service to any persons who cause a nuisance, conduct themselves in an offensive or disorderly manner, or threaten, in any way, theirs or the safety of others. In such a circumstance Summit to Sea Adventures will not be responsible for any damage or injury sustained by you as a result of your behaviour. Should Summit to Sea Adventures exercise our right to refuse service, you forfeit all monies paid to Summit to Sea Adventures.

Smoking Policy

Summit to Sea Adventures would like to advise persons that no smoking is allowed in or outside the vehicle.

Our website may contain links to enable you to visit other websites of interest easily. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.

The contents of Summit to Sea Adventures publications, including Summit to Sea Adventures website are protected by copyright and may not be copied, stored or transmitted, in any part, without the prior written consent of Summit to Sea Adventures.

Data Protection Act

Summit to Sea Adventures takes your personal security very seriously. Your personal information will only be used to provide you a Summit to Sea Adventures Tour. We will not use your personal information for marketing activities. You may opt out from receiving emails from Summit to Sea Adventures.

Medical Declaration

The activities undertaken at Summit to Sea Adventures can involve strenuous physical exercise. Participants can be exposed to cold and wet conditions and circumstances where the carrying of heavy loads is required. You should consider your personal health and fitness before participating. Anyone suffering from, or ever having suffered from, any medical condition, illness or injury or who is pregnant should consult their doctor regarding the suitability of their participation. Participants with concerns should only attend following advice from their doctor and should make their condition known to Summit to Sea Adventures.

As soon as we receive a complaint action will be taken to rectify the problem. If you contacted us by post or email we will reply by email. If you contact us by phone we aim to be able to resolve the issue immediately. If we need a little time to investigate the matter then no later than the following working day.
